Deferred Prosecution

What is Deferred Traffic Prosecution?

If you get a ticket, Deferred Traffic Prosecution can keep points off your driving record.

If you qualify, you pay a fine like a normal ticket. Depending on your record, you might also have to take traffic school online and pay for that. Then the charge gets dismissed if you have a clean record for 1 year.

Deferred Traffic Prosecution adds an additional $5 administrative fee to your fine.
Traffic School Deferred Traffic Prosecution adds an additional $5 administrative fee to your fine then a cost of $40 to take traffic school.

The process is simple to apply:

The process is voluntary, although not everyone will qualify. You can contact the court and they will know if you qualify or not. The qualifications consider many factors like age (over 21), state license (Utah only), and driving record.

You can choose to not participate in Deferred Traffic Prosecution and instead go through the normal processes like paying the fine or going to court to contest the charge. If a court date is set, Deferred Traffic Prosecution will no longer be an option.

Signing up is time sensitive and you only have 21 days from receiving your citation to sign up. If you miss the time frame, the option will no longer be available and you will just have to pay the fine.

If you sign up for the program, you will then need to contact the court to pay the fine and fee or go the “Payments” tab on the Justice Court page. You will not be able to pay on the UTCourts website.

Please contact the court with any questions.
